Welcome to EQCHEN. These Terms of Service ("Terms") govern your use of our website eqchen.com (the "Site") and the purchase of commercial kitchen equipment and related products from EQCHEN ("we," "us," or "our").
By accessing or using our Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or purchase our products.
1. GENERAL TERMS
1.1 Acceptance of Terms
By placing an order, creating an account, or using our Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
1.2 Eligibility
You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our Site and purchase our products. Our products are intended for commercial and business use.
1.3 Account Registration
You may be required to create an account to access certain features or make purchases. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Providing accurate and complete information
2. PRODUCTS AND PRICING

- The price charged will be the price displayed at the time of order placement
- We reserve the right to correct pricing errors
- Bulk and wholesale pricing may be available upon request

- All products are subject to availability
- We reserve the right to discontinue products at any time
- If a product becomes unavailable after your order, we will notify you and offer a refund or substitute
3. ORDERS AND PAYMENT
3.1 Order Acceptance
Your order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including:
- Product availability
- Errors in pricing or product information
- Suspected fraudulent activity
- Credit verification issues
Order confirmation does not constitute acceptance. Acceptance occurs when we ship your order or send shipping confirmation.
3.2 Payment Methods
We accept the following payment methods:
- Visa, Mastercard, Maestro, American Express
- Discover, JCB, Diners Club
- Other payment methods as displayed at checkout
3.3 Payment Terms
- Payment is due in full at the time of order placement unless otherwise arranged
- For B2B/wholesale customers, net payment terms may be available upon credit approval
- All payments are processed securely through PCI-DSS compliant payment processors
- You authorize us to charge your payment method for the total order amount, including taxes and shipping
3.4 Sales Tax
Applicable sales tax will be calculated and added to your order based on your shipping address and local tax regulations.
4. SHIPPING AND DELIVERY
4.1 Shipping Coverage
We ship to addresses within the contiguous United States only. We do not ship to:
- Alaska
- Hawaii
- U.S. territories (Puerto Rico, Guam, etc.)
- International addresses
4.2 Delivery Time
- Standard delivery: 2-7 business days after order processing
- Delivery times are estimates and not guaranteed
- Processing time is typically 1-2 business days
- Large or custom orders may require additional processing time
4.3 Shipping Method
- Free curbside delivery included
- Free liftgate service included
- Signature may be required upon delivery
- You are responsible for providing accurate shipping information
4.4 Delivery Inspection
IMPORTANT: You must inspect all shipments upon delivery:
- Check outer packaging for visible damage
- Note any damage on the delivery receipt and take photos
- Inspect the equipment after unboxing
- Report any damage or defects within 48 hours of delivery
- Failure to inspect and report damage may affect warranty claims
4.5 Refused or Undeliverable Shipments
If you refuse delivery or if a shipment is undeliverable due to incorrect address or unavailability, you may be responsible for return shipping costs and restocking fees.
5. RETURNS AND REFUNDS
5.1 Return Policy
We accept returns within 30 days of delivery under the following conditions:
- Product must be in new, unused condition
- Original packaging must be intact and undamaged
- All accessories, manuals, and components must be included
- Return authorization (RMA) must be obtained prior to return
5.2 Restocking Fees
- Commercial equipment returns: 20% restocking fee
- Residential equipment returns: 30% restocking fee
- Custom or special orders: Non-returnable
5.3 Non-Returnable Items
The following items cannot be returned:
- Used, installed, or damaged equipment
- Equipment with broken seals or missing parts
- Custom-ordered or special-order items
- Clearance or final sale items
- Electrical items that have been plugged in or used
5.4 Return Shipping
- Customer is responsible for return shipping costs unless the return is due to our error or defect
- We recommend insured shipping with tracking
- Risk of loss during return shipping is borne by the customer
5.5 Refund Processing
- Refunds are processed within 7-10 business days after we receive and inspect the returned item
- Refunds are issued to the original payment method
- Shipping charges are non-refundable unless the return is due to our error
6. WARRANTIES
6.1 Manufacturer Warranty
All EQCHEN commercial kitchen equipment includes:
- 6-year compressor warranty
- 2-year parts and labor warranty
6.2 Warranty Claims
To make a warranty claim:

- Provide proof of purchase and description of the issue
- Follow our warranty claim procedures
- Warranty does not cover damage from misuse, improper installation, or normal wear and tear
6.3 Disclaimer of Warranties
EXCEPT AS EXPRESSLY PROVIDED, ALL PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid for the product
- We are not liable for delays, failures, or damages caused by events beyond our reasonable control
- We are not responsible for installation, operation, or maintenance of equipment
8. INTELLECTUAL PROPERTY
8.1 Ownership
All content on our Site, including text, graphics, logos, images, and software, is the property of EQCHEN or its licensors and is protected by copyright, trademark, and other intellectual property laws.
8.2 Restrictions
You may not:
- Copy, reproduce, or distribute Site content without permission
- Use our trademarks or branding without authorization
- Modify, reverse engineer, or create derivative works
- Use unauthorized automated systems, bots, or scrapers to maliciously access, extract, or scrape our Site. Authorized AI shopping assistants and channels (including but not limited to ChatGPT, Google Gemini, Microsoft Copilot, and other Shopify-approved AI platforms) are permitted to access our Site to provide product recommendations and facilitate purchases for customers.
9. USER CONDUCT
You agree not to:
- Violate any applicable laws or regulations
- Provide false or misleading information
- Interfere with the operation of our Site
- Attempt to gain unauthorized access to our systems
- Use our Site for fraudulent purposes
- Harass, abuse, or harm others
10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless EQCHEN, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of our Site or products
- Your violation of these Terms
- Your violation of any third-party rights
- Improper installation, use, or maintenance of equipment
11. DISPUTE RESOLUTION
11.1 Governing Law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
11.2 Jurisdiction
Any disputes arising from these Terms or your use of our Site shall be resolved in the state or federal courts located in New York County, New York.
11.3 Informal Resolution
Before filing a claim, you agree to contact us at sales@eqchen.com to attempt to resolve the dispute informally.
12. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site with an updated "Last Updated" date. Your continued use of the Site after changes constitutes acceptance of the modified Terms.
13. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and EQCHEN regarding your use of our Site and purchase of our products.
